These terms govern your use of the Falkyn desktop application and related services. By installing or using Falkyn, you agree to them. If you do not, do not use the application.
Falkyn is a desktop application for search and content analysis. It runs on your computer, stores your work locally, and connects to external services — including AI models and, at your option, Google Search Console — to carry out the tasks you ask of it.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Falkyn. You may not resell it, redistribute it, reverse engineer it, or remove its notices, except where the law says you may regardless of this agreement.
Some features require an account. You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for what happens under your account. Tell us promptly if you believe it has been compromised. You must be old enough to form a binding contract where you live.
Falkyn can crawl websites, read pages, and query third-party APIs. That capability comes with obligations.
You may use Falkyn's crawling and analysis features only on sites you own, or where you have permission from the owner, or where the owner's terms and robots directives permit automated access. You are responsible for that judgement — not us.
You also agree not to:
Falkyn connects to services operated by others — Google, AI model providers, and any optional integrations you configure yourself, such as DataForSEO or a Model Context Protocol server. Your use of those services is governed by their terms, not ours, and we are not responsible for their availability, accuracy, pricing, or conduct.
Where you supply your own API credentials for a third-party service, any charges that service bills are yours.
Falkyn uses AI models to analyse data and produce recommendations, reports, and copy. AI output can be wrong, incomplete, or confidently mistaken. It is a starting point for your professional judgement, not a substitute for it.
Verify anything you intend to act on, publish, or present to a client. We make no warranty that AI output is accurate, current, or fit for any purpose, and you are responsible for what you do with it.
You keep ownership of the data you bring into Falkyn and the work you produce with it. We claim no ownership of your crawls, reports, or content. You grant us only the limited permission needed to operate the application on your behalf — for example, transmitting your prompt to a model provider so it can answer.
We may update, change, or discontinue features. We may impose reasonable limits on usage of services we pay for. Where a change materially reduces what you get, we will make reasonable effort to tell you. We do not guarantee uninterrupted availability of any connected service.
Falkyn is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the application will be error-free, that defects will be corrected, or that results obtained will be accurate or reliable.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost revenue, lost data, or business interruption, arising out of your use of Falkyn — whether or not we were advised such damages were possible.
Where liability cannot be excluded, our total liability for any claim relating to Falkyn is limited to the amount you paid us for it in the twelve months before the claim arose, or one hundred US dollars, whichever is greater.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your use of Falkyn in breach of these terms or of any law — including claims brought by a website owner whose site you crawled without permission.
You may stop using Falkyn at any time by uninstalling it. We may suspend or terminate access if you breach these terms, or if required to protect the service or other users. Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability, indemnity — do survive it.
We may revise these terms. The date at the top will change and the revised version will be posted here. Continued use after a revision means you accept it. If you do not, stop using Falkyn.
These terms are governed by the laws of the jurisdiction in which Falkyn's operator maintains its principal place of business, without regard to conflict-of-law rules. Any dispute will be brought in the courts of that jurisdiction, and you consent to their jurisdiction and venue.
